I’ve been arrested for a DUI, do I need to hire a lawyer?

Hands down, this is the question that I hear most often.  While you might view my answer with some suspicion coming from an attorney, if you’ve been arrested, get an attorney. Hire my firm, hire someone else, apply for a court appointed attorney if you need to, but find someone who knows what they are doing to help you so you can get the best possible outcome in a situation that isn’t as clear cut as it might first appear.

In Oregon, you absolutely have the constitutional right to represent yourself.  That being said, there are judges and jurisdictions in the Portland Metro area that will send you away from your first court appearance because you don’t have an attorney to represent you.  They will give you time to go hire a lawyer because they want you to be able to have the understanding necessary in a situation where if the worst case were to happen, you could go to jail.

Not because you aren’t smart or able to speak for yourself, but because logic does not prevail in our criminal justice system and the last thing you want is to be your own learning curve on something this serious with such lasting consequences.
